By accessing or using SiteViewXR ("the App"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our services.

2. Description of Service

SiteViewXR is an augmented reality (AR) application for construction, remodeling, and design visualization. The App provides measurement tools, 3D modeling, CAD export capabilities, and AI assistance.

3. MEASUREMENT ACCURACY DISCLAIMER

IMPORTANT: SiteViewXR is a measurement and visualization tool. We make NO WARRANTIES, EXPRESS OR IMPLIED, regarding the accuracy of measurements taken using our App. Users acknowledge and agree that:

• Measurement accuracy varies based on device capabilities, environmental conditions, user technique, and angles of measurement
• LiDAR-equipped devices may provide better accuracy but are still subject to environmental and usage limitations
• Non-LiDAR devices rely on visual estimation and camera data, which is inherently less accurate
• Professional verification is required for all critical measurements used in construction or design decisions
• We are not liable for any damages, losses, or injuries resulting from inaccurate measurements, regardless of the magnitude of inaccuracy

4. User Responsibilities

You are responsible for:

• Verifying all measurements with professional tools before making construction decisions
• Understanding your device's limitations and capabilities
• Following proper measurement techniques and safety procedures
• Maintaining the confidentiality of your account credentials
• Complying with all applicable laws and regulations
• Not using the App for unlawful or prohibited purposes

5. Subscription Terms

5.1 Billing

Subscriptions are billed monthly or annually in advance. Prices are subject to change with 30 days notice.

5.2 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

5.3 Refunds

We offer refunds according to Apple's App Store refund policy. Storage add-ons are non-refundable and non-prorated upon cancellation.

6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• SITEVIEWXR IS PROVIDED "AS IS" without warranties of any kind
• WE DISCLAIM ALL WARRANTIES regarding measurement accuracy, device compatibility, or fitness for a particular purpose
• WE ARE NOT LIABLE for any direct, indirect, incidental, consequential, or punitive damages
• OUR TOTAL LIABILITY shall not exceed the amount you paid for the service in the 12 months preceding the claim
• WE ARE NOT RESPONSIBLE for construction errors, project delays, cost overruns, or safety incidents related to App usage

7. Intellectual Property

SiteViewXR and all related content, features, and functionality are owned by us or our licensors. You retain ownership of your project data and content created using the App.

8. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Third-Party Services

The App may integrate with third-party services (partner stores, payment processors, etc.). Your use of these services is subject to their respective terms and policies.

10. Professional Use Disclaimer

SiteViewXR is intended as a visualization and preliminary measurement tool. For professional construction projects:

• Always verify measurements with calibrated professional instruments
• Consult with licensed professionals for structural and safety decisions
• Follow local building codes and regulations
• Obtain proper permits and inspections as required

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, violation of these terms, or infringement of third-party rights.

12. Termination

We may terminate or suspend your account immediately for violations of these terms. Upon termination, your right to use the App ceases, though data retention policies may apply.

13. Governing Law
